GENERAL TERMS AND CONDITIONS

INTRODUCTORY PROVISIONS

 

  1. The General Terms and Conditions apply to photographic expeditions, photographic workshops and  photography courses organized by Filip Hrebenda - Filip Hrebenda Photography, Litovelská 21, 050 01 Revúca, Slovak Republic, IČO: 52159906 (Hereinafter referred to as “Organizer”)

  2. The organizer provides services (sells participation in photography workshops, photography expeditions and photography courses) by ordering on the website www.filiphrebenda.com. 

  3. These General Terms and Conditions are part of the order of the photo workshop, photo expedition or photo course concluded between the Organizer and the customer (customer of the services provided)

 

Part I.  - SUBJECT OF THE CONTRACT

 

The General Terms and Conditions set out the rights and obligations of the parties (the Organizer and the customer) in providing the following services:

  1. photography workshops

  2. photographic expeditions

  3. photography courses

 

Part II.  - PARTICIPANTS IN THE CONTRACT

 

The parties to the contract are:

a) Organizer - Filip Hrebenda - Filip Hrebenda Photography, Litovelská 21, 050 01 Revúca, Slovak Republic, ID: 52159906 

b) customer - participant of a photographic workshop, customer - participant of a photographic expedition or customer - participant of a photographic course (hereinafter referred to as “Customer”)

 

Part III.  - ESTABLISHMENT OF A CONTRACTUAL RELATIONSHIP AND SUBJECT OF THE CONTRACT

 

  1. Based on the order on the website www.filiphrebenda.com , a contractual relationship is established between the Organizer and the Customer

  2. The date of the photo workshop / photo expedition / photo course, and its length is clearly stated in the order of the photo workshop / photo expedition / photo course.

  3. Accommodation, meals and other services that may be mentioned in the order for the photo workshop / photo expedition / photo course organized by the Organizer are not part of the services provided by the Organizer

 

 

Part IV. - PAYMENT AND PRICE CONDITIONS

 

  1. The customer is obliged to pay the full price of the photo workshop / photo expedition / photo course

  2. The Customer is obliged to pay the price of the photo workshop / photo expedition / photo course within the deadline specified in the workshop order by transfer to the Organizer's bank account specified in the order.

  3. The amount of the price of the photo workshop / photo expedition / photo course, possible deposit for it and possible discounts is determined in the order, unless the parties agree otherwise on the basis of written communication.

  4. The organizer (Filip Hrebenda - Filip Hrebenda Photography, Litovelská 21, 050 01 Revúca, Slovak Republic, IČO: 52159906) is not a VAT payer.

 

Part V.  RIGHTS  CUSTOMER OBLIGATIONS

 

  1. Basic rights of the Customer:

a) the right to provide the agreed, ordered and paid service,

b) the right to the protection of personal data that are part of the order for a photo workshop / photo expedition / photo course

c) the right to information concerning the photo workshop / photo expedition / photo course and all ordered and paid services, if this information is not published on the website www.filiphrebenda.com . The Organizer will usually provide this information to the Customer via e-mail or telephone communication

d) the right to be informed in good time of changes concerning the ordered and paid services by e-mail or telephone communication

(e) the right to arrange participation in  a photographic workshop / photographic expedition / photographic course to a third party, if this third party meets the conditions for participation in a photographic workshop / photographic expedition / photographic course. The Customer is obliged to inform the Organizer about such mediation immediately and in writing via e-mail communication.

 

2. Basic obligations of the Customer:

a) provide the Organizer in the order for the photo workshop / photo expedition / photo course with true data that are necessary for the correct provision of the ordered and paid service, including any changes to this information.

b) in the event that the Customer is a person under the age of 18 and over the age of 15, to submit the consent of legal representatives to the conclusion of a contract between the Customer and the Organizer.

c) arrive at the venue of the photographic workshop / photographic expedition / photographic course specified in the order, unless the venue is determined otherwise by written (e-mail) communication,

d) follow the instructions of the Organizer of the photo workshop / photo expedition / photo course, follow the regulations of the country in which the photo workshop / photo expedition / photo course takes place, follow the program of the photo workshop / photo expedition / photo course, follow the rules of accommodation providers and carriers the customer uses the services (these services are not part of the services offered by the Organizer) and comply with the customs regulations of the individual countries in which the photo workshop / photo expedition / photo course takes place. (Quantity of transported commodities such as alcohol, etc.)

e) in the case of a photo workshop / photo expedition / photo course held abroad, to carry all the necessary documents necessary to enter the country where the photo workshop / photo expedition / photo course takes place, including transit countries,

f) fulfill the vaccination (or testing and other health obligations, including medical certificates), before traveling to the country where the photo workshop / photo expedition / photo course takes place, if that country requires such obligations, 

g) to avoid conduct that would in any way violate the rights of other Customers, including conduct that would endanger their health, life, or conduct that could cause damage to property of other Customers

 

Part VI. OBLIGATIONS  ORGANIZER 'S RIGHTS

 

1. The obligations and rights of the Organizer are directly related to the rights and obligations of the Customer (Based on Part V.).

2. Organizer  is obliged to sufficiently and truthfully inform the Customer  of all facts concerning the contract service, or of any change in these facts sufficiently in advance.

3. The organizer is not a travel agency or a travel agency because it does not provide services specific to a travel agency.

4. The services provided by the Organizer do not include accommodation, transport, insurance, food and other similar services characteristic of the services of travel agencies or travel agencies. At the same time, these services are not included in the price of the photo workshop / photo expedition / photo course.

5. The organizer only provides the customer with a service in the form of conducting a photo workshop / photo expedition / photo course.

 

Part VII. CANCELLATION  CHANGES IN ORDERED SERVICES

 

  1. Cancellation of the service by the Organizer:

The organizer has the right to cancel the photo workshop / photo expedition / photo course:

 

  1. If the minimum number of Customers is not reached. The minimum number of Customers is listed on the information website www.filiphrebenda.com . The workshop is conditioned by reaching a predetermined minimum number of Customers.

  2. If an epidemiological or other emergency situation does not allow entry to the country where the photo workshop / photo expedition / photo course is to take place.

  3. In the event of cancellation of the photo workshop / photo expedition / photo course by the Organizer, the Organizer is obliged to immediately notify the Customer of this fact via written communication (via e-mail) or by telephone. In such a case, the Organizer is obliged to inform the Customer of this fact no later than 24 hours before the start  photography workshop / photography expedition / photography course

  4. In the event of cancellation of the photo workshop / photo expedition / photo course by the Organizer for the reasons mentioned in the previous points and if the Customer has not violated its obligations to which these General Terms and Conditions bind, the Customer has the right to request participation in another similar photo workshop / photographic expedition / photographic course in the event that such a photographic workshop / photographic expedition / photographic course can be offered to the Customer by the Organizer. In such a case, participation in the alternate date of the photo workshop / photo expedition / photo course will be confirmed by a new order from the Customer. If the amount of the replacement photo workshop / photo expedition / photo course is the same as in the case of the canceled service, any payment paid for this service by the Customer will be transferred to the new order. If the amount of the replacement photo workshop / photo expedition / photo course is lower than in the case of the canceled service, the Organizer will immediately pay the difference to the Customer. If the amount of the replacement photo workshop / photo expedition / photo course is higher than in the case of the canceled service, the Customer will immediately pay the difference in price to the Organizer. If a new order is not concluded by the Customer, it is the Organizer  obliged to return to the customer without delay (within 14 days at the latest) the entire price for the service paid by the Customer until then. In such a case, the customer is not obliged to pay for the cancellation of participation in  photo workshop / photo expedition / photo course. In such cases, the Customer is not entitled to any other compensatory compensation in addition to the amount paid in advance for the service canceled by the Organizer.  

 

2. Cancellation of the ordered service by the Customer:

The customer has the right to withdraw from participation in  photo workshop / photo expeditions / photo course before it starts:

 

a) without giving a reason,

(b) in the event that it does not conclude a new order pursuant to Part VII, paragraph 1c) and 1d),

c) z  due to a breach of the Organizer's obligations to which the order or these General Terms and Conditions bind him

d) The Customer is obliged to immediately notify the Organizer in writing (e-mail) or by telephone of the cancellation of the ordered service.

 

Part VIII - CANCELLATION AND CHARGES RELATED TO IT

 

1. Cancellation fees in  in case of cancellation of the photo workshop / photo expedition / photo course by the Organizer:

 

  1. The Organizer will return to the Customer 100% of the funds that the Customer has paid in advance to the Organizer's account for the canceled photo workshop / photo expedition / photo course.

  2. b) In such  In this case, the Customer is not entitled to any compensation from the Organizer other than the amount paid by the Customer  paid in advance for the service canceled by the Organizer.

 

2. Cancellation fees in  in case of cancellation of participation in the photo workshop / photo expedition / photo course by the Customer:

 

  1. Cancellation of participation in  60 or more days before the start of the photo workshop / photo expedition / photo course, the Organizer will return to the Customer's account the full amount (100%) of the funds paid out by the Customer to the Organizer in the period before the cancellation of participation in the photo workshop / photographic expedition / photographic course, unless otherwise specified in the order.

  2. Cancellation of participation in  photo workshop / photo expedition / photo course 21 to 59 days before the start of the photo workshop / photo expedition / photo course, the Organizer will return to the Customer's account half (50%) of the paid funds paid by the Customer to the Organizer in the period before the participation in the photo workshop / photo course. shipping / photography course, unless otherwise stated in the order.

  3. Cancellation of participation in  photo workshop / photo expedition / photo course 0 to 20 days before the start of the photo workshop / photo expedition / photo course or if the Customer does not attend the photo workshop / photo expedition / photo course without giving a reason, the Organizer will return 0% to the Customer's account paid funds, which the Customer paid to the Organizer in the period before the cancellation of participation in the photo workshop / photo expedition / photo course, unless otherwise specified in the order.

 

 

Part IX - COMPLAINTS

 

1. In the event that the service provided by the Organizer is defective, the customer has the right to complain about this service. 

2. The Customer is obliged to notify the Organizer of the claim for a complaint immediately after finding a defect in the service provided orally or in writing, so that a correction can be made as soon as possible.

3. The organizer is obliged to issue a written confirmation of receipt of the complaint to the customer.

4. The Customer is obliged to provide the Organizer with sufficient information and facts that led to the claim. At the same time, the Customer is obliged to cooperate sufficiently with the Organizer in the matter of the complaint.

5. Circumstances that do not directly depend on the activities or procedures of the Organizer do not apply to the right to file a complaint (Adverse weather, other unexpected effects, force majeure)

6. In the circumstances, on  on the basis of which the Customer does not fully or partially use the service provided by the Organizer does not entitle the customer to  refund of the amount he paid as a price for the service. In such a case, the customer is not entitled to make a complaint or a discount on the price of the service.

 

Part X - INSURANCE

 

1. As the Organizer is not a travel agency or travel agency, the offered services do not include insurance for trips abroad, insurance for mountain terrain, property insurance, accident insurance, liability insurance and the like.

2. The organizer shall not be liable for any damages caused by the customer's behavior, liability for any injuries, death of the customer or conduct that is not in accordance with the laws of the country in which the photo workshop / photo expedition / photo course takes place, from start to finish. photography workshop / photography expedition / photography course including trip to it.

3. In the case of the events referred to in Part X, paragraph 2 Neither the Customer nor anyone else is entitled to compensation, indemnification or damages by the Organizer.

4. The customer is fully aware of the fact that in case of failure to arrange the relevant insurance, he / she takes full responsibility for the consequences of his / her actions and possible injuries during the photo workshop / photo expedition / photo course, including the trip to it.

5. The Customer is acquainted with the complexity of the photo workshop / photo expedition / photo course through the information website www.filiphrebenda.com or through written (e-mail) communication with the Organizer. 

6. The customer is fully responsible for his safety throughout the workshop. The photo workshop / photo expedition / photo course can take place in difficult terrain in difficult weather conditions (strong wind, rain, snow, etc.). He is sufficiently informed of this fact by the Organizer in advance.

 

FINAL PROVISIONS

 

  1. By filling in the data in the order of the photo workshop / photo expedition / photo course, the Customer declares that he has read these General Terms and Conditions well, that he has no objections to them, that he fully understands them and will fully respect them.

  2. By filling in the data in the order of the photo workshop / photo expedition / photo course, the Customer declares that he did not hide from the Organizer the known possible health restrictions or problems that could jeopardize the course of the photo workshop / photo expedition / photo course. In such a case, it is necessary to discuss this fact with the Organizer.

  3. These General Terms and Conditions shall enter into force on 01 August 2020. These General Terms and Conditions shall govern the obligations incurred by the Organizer and the Customer arising from the date of their entry into force.
